Dog Bite Statistics
According to statistics, animal attacks in particular dog bites, are among the leading causes of physical injuries in the United States. Almost 2% of the American population are victims of dog bites each year and these incidents commonly occur because of the owner or possessor's negligent handling of the animal. Unfortunately, such failure to exercise proper care and attention in the custody of their dogs led to the personal injuries of innocent persons.
Strict Liability Rule in Dog Bite Incidents
California statute on dog bites imposes “strict liability” upon the dog owner when the dog has bitten another person. Section 3342 of the California Civil Code specifically states that:
“The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner's knowledge of such viciousness. A person is lawfully upon the private property of such owner within the meaning of this section when he is on such property in the performance of any duty imposed upon him by the laws of this state or by the laws or postal regulations of the United States, or when he is on such property upon the invitation, express or implied, of the owner.” (Section 3342)
Under this provision, it is clear that dog owners shall be held liable for any physical injury caused upon another because of the dog bite incident.
